National Consultant for monitoring the implementation of international obligations of Ukraine in anti-corruption field for National Agency on Corruption Prevention
Terms of Reference
1. Background
Support to anti-corruption efforts in Ukraine is a high political priority for the European Union. By combatting corruption, the EU contributes to the consolidation of democracy and economic growth of Ukraine, as well as successful approximation of Ukraine with the EU.
Based on the significant results of the joint Danish and EU Anti-Corruption Initiative (EUACI) in Phase I 2017-2020, Denmark and the EU engaged in a second phase of the programme aimed at sustaining existing results and further expanding the support to newly established institutions, support to municipalities, civil society, media and the business sector. EUACI Phase II builds on the Ukrainian anti-corruption reform agenda and is intended for implementation in 24 May 2020 – 8 July 2024.
October 2019 Ukrainian Parliament amended the Law on Corruption Prevention to ensure the effectiveness of the corruption prevention institutional mechanism by relaunching the agency. EUACI has been actively supporting restructuring process of the agency following these legislative amendments. Relaunch of the agency and open and competitive NACP Head selection process re-established the trust among many international actors to re-engage with the agency. NACP is using this opportunity to invigorate the agency by designing and implementing a number of reforms in different areas of the competences of the agency in order to ensure the effectiveness of the corruption prevention institutional mechanism and deliver real and substantial result.
EUACI supports key areas of NACP’s multi-pronged mandate, including strengthening the governance and administrative and institutional capacities to ensure sustainable institutional development of NACP. According to the Law On Prevention of Corruption, the NACP’s mandate includes coordination of implementation of international obligations in the field of formation and implementation of anti-corruption policy, cooperation with state bodies, non-governmental organizations of foreign states and international organizations within its competence. Hence, assistance with building capacity of the international unit, enabling effective communication and cooperation with foreign partners and assisting in developing capacities, required for gathering and analyzing information related to the implementation of international obligations of Ukraine in anti-corruption field is seen as an integral part of ensuring sustainable institutional development of NACP.
2. Objective
The main objective of technical support to be provided to the NACP within the framework of this engagement is to contribute to efficient performance of NACP’s International Unit. The assignment will contribute towards this end by contributing to the NACP’s function of coordination of implementation of international obligations in the field of formation and implementation of anti-corruption policy, cooperation with state bodies, non-governmental organizations of foreign states and international organizations within its competence. EUACI intends to make this contribution by signing a contract with a relevant professional consultant.
3. Scope of work and expected deliverables
Scope of work
National Consultant for monitoring the implementation of international obligations of Ukraine in anti-corruption field is expected to work in close cooperation with NACP and fulfill the following tasks:
- Improving the process of organizing monitoring of implementation by NACP for various monitoring rounds of international organizations like OECD and GRECO (including but not limited to GRECO and Istanbul action plan), gather and analyse information necessary to assess the progress of response of Ukraine to corruption in accordance with international obligations;
- Provide advice and assistance, where necessary and required, to enhance and upgrade relevant legislative and other measures in conformity with international obligations of Ukraine in anti-corruption field;
- Assist in designing, developing and upgrading National Anti-corruption Strategy, State Programme and relevant government action plans with regard to international obligations of Ukraine;
- In the context of implementation of above tasks foster contacts and, where appropriate, co-operation and partnerships with bodies and institutions at national, regional and global levels tasked with the prevention of and fight against corruption;
- Assist with coordination of national stakeholders that participate in the implementation of international obligations of Ukraine in anti-corruption field, provide recommendations to better streamline coordination;
- Support the strengthening and capacity-building of the International Unit through providing expert advice and input to the development and implementation of a monitoring framework for international obligations of Ukraine;
- Provide technical guidance and expertise to NACP’s International Unit with regard to conducting and/or follow-up for assessments of the progress of Ukraine with regard to fulfilling country’s international obligations;
- Develop and deliver targeted training courses based on needs analysis for key personnel of International Unit;
- Coordinate activities with other external/embedded experts and where relevant, implement activities jointly;
- Other tasks as assigned.
Consultant will be expected to work in close cooperation with NACP and coordination with EUACI representatives and will be required to report following the implementation of tasks.
Expected deliverables
- Improved process of organizing monitoring of implementation by NACP for various monitoring rounds of international organizations like OECD and GRECO (including but not limited to GRECO and Istanbul action plan), including drafts of second compliance report of 4th round of GRECO evaluation of Ukraine & self-assessment of Ukraine on 5th round of GRECO evaluation are prepared as a result of implementation of the above tasks and finalized based on the feedback received from government and non-government stakeholders and review of the draft report in the framework of the pilot round of OECD monitoring of Ukraine;
- Recommendations for enhancement and upgrade of the relevant legislative and other measures in conformity with international obligations of Ukraine in anti-corruption field provided;
- Recommendations for upgrading national anti-corruption strategy and other relevant policy documents with regard to international obligations of Ukraine provided;
- Connections/cooperation with bodies and institutions at national, regional and global levels established and fostered;
- Map of national parties that participate in the implementation of international obligations of Ukraine, recommendations for better streamlining the coordination of national stakeholders that participate in the implementation of international obligations of Ukraine in anti-corruption field;
- Framework for minoring the implementation of international obligations of Ukraine in anti-corruption field is developed;
- Number and essence of training developed and conducted for the staff of the International Unit are reported;
- Other thematic documents, including briefing notes, minutes and charts are developed;
- A final report of maximum 5 pages, excluding annexes as the final deliverable. The report shall provide an assessment of the achievements made in relation to the scope of work and deliverables, and any critical issues/recommendation for possible follow-up.
4. Timeline
The period of implementation of the contract will be 8 months, with a duration of 100 working days. The intended commencement date is the date of signature of the contract with consultant.
5. Professional Requirements
Education and Experience:
- Advanced University degree (Master’s degree or equivalent) in International Relations, Law, Political and Social Sciences or a related discipline. A first-level university degree in similar fields in combination with two additional years of qualifying experience may be accepted in lieu of the advanced university degree;
- A minimum of 5 years of professional experience of:
- working for or providing technical assistance/advise to anti-corruption agencies on issues related to international cooperation;
- working as an anticorruption expert/advisor for an international organization/technical assistance programme/non-governmental organization.
- Experience in designing national anti-corruption policies, strategies, and public campaigns, is desirable;
- Fluency in written and oral Ukrainian and English.
6. Estimated budget and level of effort
The requested input is a total of 100 working days in 8 months, which is around 12 working days a month. The full budget for this assignment all included may not exceed EUR 15,000 (approximately DKK 111,538).
7. Monitoring and evaluation
Definition of indicators
The performance of the contractor will be judged upon reaching the purpose of this contract as well as obtaining its results, as indicated in the sections "Objective" and "Expected Deliverables" herein respectively. Moreover, the performance of the contractors will be judged upon successful implementation of all the specific activities indicated above.
Special requirements
By signing the contract, the contractors agree to hold in trust and confidence any information or documents ("confidential information"), disclosed to the contractors or discovered by the contractors or prepared by the contractors in the course of or as a result of the implementation of the contract, and agrees that it shall be used only for the purposes of the contract implementation and shall not be disclosed to any third party.
The contractor reports to the EUACI. The contractor shall be briefed prior to starting with the assignment. The contractor shall de-brief the EUACI prior to finalising the assignment.
The contractor shall immediately inform the EUACI after 50% and again after 75% use of the overall foreseen working days under this contract.
7. Cross-cutting issues (integration of the youth, equal opportunities)
The project will be implemented ensuring equal opportunities for men and women and integration of the youth.
