Risk Manager and Lead Implementer training for National Agency for Corruption Prevention staff 

Terms of Reference 

  1. Background 

Support to anti-corruption efforts in Ukraine is a high political priority for the European Union. By combatting corruption, the EU contributes to the consolidation of democracy and economic growth of Ukraine, as well successful approximation of Ukraine with the EU.

The programme “EU Anti-Corruption Initiative in Ukraine (EUACI)” is a three-year programme (2017-2019) implemented by the Danish Foreign Ministry using the indirect implementation modality. The overall objective of the programme is to improve the implementation of anti-corruption policy in Ukraine, thereby ultimately contributing to a reduction in corruption. In pursuing this objective, the programme supports all key national institutions, including National Agency on Corruption Prevention (NACP) – central executive authority established in 2016 and mandated to shape and implement anti-corruption policy, verify electronic asset declarations filed by public officials, monitor and identify instances conflict of interests, overview of political party finances and handle reports and protection of whistle-blowers. 

Since its launch in 2016, EUACI had to limit over the time the scale of the support and engagement with the NACP due to the lack of progress and commitment from the side of the agency in the areas pivotal for the prevention of corruption in Ukraine.

In October 2019 Ukrainian Parliament amended the Law on Corruption Prevention to ensure the effectiveness of the corruption prevention institutional mechanism. Amendments restructured the management of the NACP and introduced the new governance model. From collegial decision-making body, NACP was transformed into a single-chaired body, assigning to its head a broad governing mandate and powers.  The competition for a new NACP Head was launched. On 16 December 2019, the Selection Commission announced the results of the competition and Mr. Oleksandr Novikov was appointed as the Head of the agency. 

EUACI has been actively supporting restructuring process of the agency following the legislative amendments of October 2019 to the Law on Corruption Prevention providing comprehensive support of the process that included nomination of the experts to the competition commission, contribution of experts to its secretariat, methodological support etc. 

Relaunch of the agency and open and competitive NACP Head selection process re-established the trust among many international actors to re-engage with the agency. NACP is using this opportunity to invigorate the agency by designing and implementing a number of reforms in different areas of the competences of the agency in order to ensure the effectiveness of the corruption prevention institutional mechanism and deliver real and substantial result. 

Key priority areas include strengthening the governance and administrative and institutional capacities regarding e-asset declarations and their verification, conflict of interest as well as strengthening the capacity of the agency in relation to corruption risk assessment. 

It is necessary to consider that in April 2020 the Risk Manager training based on ISO 31000 standard was successfully conducted for the staff of NACP Corruption Prevention Department. In November 2020 EUACI was approached by the new management of NACP to support the agency in attaining urgent objectives of strengthening and reforming regulatory anti-corruption framework. For these purposes, the agency requested to support the staff of NACP Internal Control department with the Risk Manager training based on ISO 31000 standard and of NACP Corruption Prevention Department with the Lead Implementer training based on ISO 37001.

 

2. Objective

The main objective of technical support is to provide timely and effective assistance to NACP in attaining urgent priorities defined by their reform agenda in the key priority areas described above and overcome existing challenges that the institution faces, thus ensuring agency’s effective functioning and fulfilling of their mandate. 

 

In achieving these goals, EUACI in coordination with NACP and service provider aims at providing to the participants: 

  • understanding of the concepts, approaches and methods that allow to conduct effective risk management in accordance with ISO 31000, and lead implementation according to ISO 37001;
  • understanding of the relationship between risk management and compliance with the various stakeholders of the organization;
  • necessary knowledge to implement, maintain and manage a continuous risk management program in accordance with ISO 31000 and ISO 37001;
  • knowledge to provide effective guidance to the organization's management using best practices in risk management and lead implementation. 

 

3. Scope of work and expected deliverables

     3.1 Scope of work

The selected service provider will be responsible for assisting the EUACI in providing technical assistance with Risk Manager training according to the ISO 31000 standard and Lead Implementor according to the ISO 37000 standard. The responsibility of the service provider will include the following tasks:  

  • Conducting a five-day training of ISO 37001 standard to two groups of NACP participants (up to 20 participants in total) according to the given training curriculum 
  • Conducting a three-day training of ISO 31000 standard to a group of NACP participants (up to 12 participants in total) according to the given training curriculum; 
  • Sharing necessary reading materials before trainings; 
  • Preparing two groups to the certified exams on Lead Implementor qualification according to the ISO 37001 standard and one group on Risk Manager qualification according to the ISO 31000 standard;
  • Providing the possibility for participants to pass the qualification exam (registering/paying registration fee/ guiding etc.). 
  • Other supporting tasks

 

3.2 Expected deliverables

  • 5-day training of ISO 37001 for 20 participants through online platform; 
  • 3-day training of ISO 31000 for 12 participants through online platform; 
  • Reading materials 
  • Certificates (if the exam is passed). 

 

4. Timeline 

The intended commencement date is the date of signature of the contract with consultants and the period of implementation of the contract will be preferably by January 2021.

 

5. Professional Requirements

Education and Experience of trainer/s:

  • A university degree in relevant field; 
  • At least 3 years of proven experience in production of training courses on ISO standards;
  • Necessary qualification for conducting ISO trainings (certificates, trainer’s diploma etc.) 
  • At least 3 years of relevant professional experience as a trainer;
  • Fluency in written and oral Russian/Ukrainian, English will be considered as an asset.

 

6. Monitoring and evaluation

Definition of indicators

The performance of the contractor will be judged upon reaching the purpose of this contract as well as obtaining its results, as indicated in the sections "Objective" and "Expected Deliverables" herein respectively. Moreover, the performance of the contractors will be judged upon successful implementation of all the specific activities indicated above.

Special requirements

By signing the contract, the contractors agree to hold in trust and confidence any information or documents ("confidential information"), disclosed to the contractors or discovered by the contractors or prepared by the contractors in the course of or as a result of the implementation of the contract, and agrees that it shall be used only forthe purposes of the contract implementation and shall not be disclosed to any third party.

The contractor reports to the EUACI. The contractor shall be briefed prior to starting with the assignment. The contractor shall de-brief the EUACI prior to finalising the assignment.

 

7. Cross-cutting issues (integration of the youth, equal opportunities)

The project will be implemented ensuring equal opportunities for men and women and integration of the youth.
